‘Caso Infonavit’: oportunidad para enviar un mensaje

Se ha comentado en múltiples ocasiones, pero es necesario reiterarlo en cada oportunidad que se presente: uno de los principales agravios que los ciudadanos resienten en materia de actuación de los servidores públicos es el hecho de atestiguar cotidianamente actos de corrupción y, pese a que se denuncien, estos permanezcan en la impunidad.
De forma particular, agravian los grandes casos de corrupción, aquellos en los cuales resulta evidente que, quienes participaron de ellos, utilizaron sus posiciones para obtener insultantes ganancias personales.
En ese listado se ubica el escándalo de los “juicios masivos”, desahogados en juzgados de Coahuila y otros estados de la república, y que constituyen un monumental caso de fraude contra derechohabientes del Infonavit porque se trató de juicios realizados en forma ilegal.
El problema con el caso ha sido que, pese a la denuncia y las múltiples evidencias públicamente ventiladas, no se ha percibido hasta ahora la existencia de una voluntad clara para perseguir y castigar los hechos que involucran a múltiples funcionarios judiciales de la Entidad.
Hasta ayer, cuando el recién designado presidente del Tribunal Superior de Justicia de Coahuila fijó una posición que parece clara y convoca a esperar que el hecho no quede en la impunidad.
“Mi compromiso fue darle seguimiento a este caso… y quiero resaltar que todo estos jueces y secretarios están siendo juzgados conforme a la normatividad penal. Nadie está deteniendo en Coahuila ni los procedimientos disciplinarios ni los penales”, dijo Miguel Mery Ayup, luego de anunciar la suspensión de la Oficial de Partes del Centro de Justicia de Torreón.

Se trata, sin duda, de una buena señal que debe saludarse, aunque no constituye aún la certeza de que habrá eficacia en la investigación y persecución de los ilícitos cometidos.
Pese a ello, el hecho constituye una señal que habla de un viraje en la posición guardada hasta ahora por el Poder Judicial de Coahuila, sobre todo si se tiene en cuenta que, de acuerdo con Mery Ayup, el Consejo de la Judicatura ya había informado oficialmente de los hechos a la Presidente del TSJ, sin que se tomaran acciones al respecto.
Conviene siempre ser prudentes antes de echar las campanas al vuelo, pero ni duda cabe de que el mensaje enviado con esta decisión, así como con la posición fijada, rema en la dirección correcta.
Cabría esperar ahora que, en línea con los resultados largamente reclamados por la sociedad, el escándalo de los megajuicios se convierta en un ejemplo de castigo a la corrupción y en la evidencia de que, quien viole la ley, no podrá alcanzar ya el paraíso de la impunidad.
