Mientras que el PAN mantiene su postura en contra de la interrupción legal del embarazo, Morena insiste en modificar el Código Penal de Coahuila para quitar la penalización sobre el aborto, puesto que la Suprema Corte de Justicia de la Nación resolvió que no se puede criminalizar a la mujer que tome esa decisión personal.

El 7 de septiembre de 2021, los magistrados resolvieron la invalidez del Artículo 196 y de porciones del 198, 199 y 224, para no sancionar a quien decida abortar por voluntad propia y reconoce el derecho a abortar en la primera etapa del embarazo, sin que sea criminalizada.
La diputada Mayra Valdés González (PAN) señaló que, desgaciadamente, aunque el Congreso del Estado no modifique el Código Penal, el aborto es una realidad en Coahuila y se practica aún sin las reformas porque así lo determinó la SCJN.
“Como quiera legalmente el aborto hoy en México está permitido, el que lo haga o no el Congreso no viene a cambiar nada, por la resolución de la Corte”, indicó, al señalar que Acción Nacional mantiene su defensa a favor de la vida y en contra del aborto.
“Debemos atacar este problema desde la prevención, no podemos matar a un inocente que no tiene manera de defenderse, para que la mujer practique un aborto. Estamos totalmente en contra de esta situación, son salidas fáciles que dan a las mujeres por no usar los métodos preventivos para evitar un embarazo”.
Refirió que colectivos feministas defienden el derecho de la mujer a decidir sobre su propio cuerpo, lo que se respeta, pero lamentablemente en este caso involucra a un ser inocente que tiene vida y no se puede defender. “Están matando a un bebé”, indicó, al señalar que para efectos prácticos no tiene caso reformar el Código Penal.
La legisladora Lizbeth Ogazón Nava (Morena) informó que insistirán en modificar el Código Penal, pues la SCJN resolvió que no se puede criminalizar a la mujer que aborte y ya no son aplicables los artículos y porciones que lo sancionan, disposiciones que, por ende, deben ser eliminados.
“La SCJ declaró que no se puede criminalizar a la mujer por llevar a cabo el derecho a decidir, entonces no se pueden aplicar en Coahuila por la autoridad y en caso de que lo lleguen a aplicar porque la ley aún lo dispone como delitos, pues no se podrá iniciar o seguir un proceso a una persona que haya realizado el proceso o lo haya solicitado”.
No obstante, dijo, como las disposiciones aparecen en el ordenamiento, es posible que las mujeres enfrenten una denuncia y un procedimiento de investigación por parte del Ministerio Público, lo que finalmente no procederá, y el propósito es evitar que la mujer sea sometida a este proceso porque significa revictimizarlas.
“Ya ninguna mujer podrá ser encarcelada por la resolución de la Corte, pero todavía se permite que vayan a hacer denuncias ante el MP y se inicie procedimiento sancionador que no va a terminar en nada”, explicó.
