Aunque se había contemplado en el orden del día, la acción de inconstitucionalidad sobre la penalización del aborto en Coahuila fue pospuesta por la Suprema Corte de Justicia de la Nación.
El juez Luis María Aguilar iba a presentar un proyecto de sentencia ante el Pleno de la Corte, en el quereconoce que las mujeres tienen derecho a decidir interrumpir el embarazo en su etapa inicial.
Lo que busca es eliminar el artículo que prevé hasta tres años de cárcel a las mujeres que se practican abortos de manera intencional.
“No corresponde al Estado conocer o evaluar las razones para continuar o interrumpir su embarazo ya que pertenecen a la esfera de intimidad de la mujer”, argumenta el ministro.
CONCLUYE SESIÓN
El punto de inconstitucionalidad venía como el segundo punto de la orden del día a debatir por los Ministros de la Corte; sin embargo, al concluir los primeros puntos, dieron por agotada la sesión.
En caso de que este debate se hubiera dado en la corte y se hubiera aprobado la acción de inconstitucionalidad, Coahuila habría tenido que desechar del código penal los delitos por aborto.
Mientras este debate está en espera, este año en Coahuila se duplicaron en siete meses los delitos de aborto en comparación del año pasado, pasando de ser dos indagatorias en 2020, a cuatro entre enero y julio del 2021.
Actualmente, en Coahuila no existen sentencias relacionadas con el delito de aborto; sin embargo, sí existen las carpetas de investigación vigentes.
Para la discusión, los ministros dieron pospuesto este y otros debates de la orden del día para la siguiente sesión inmediata de la Corte, en la que ya podría estar presente el ministro presidente, Arturo Saldívar.
CUIDADO CON ACTIVISMO JUDICIAL: ESPECIALISTA
El constitucionalista Juan Luis Montero señaló que la Suprema Corte de Justicia de la Nación está obligada a mantener congruencia con los fallos en los que respeta las facultades de los congresos locales a legislar sobre temas que no son exclusivos para la Federación.
En el marco de la próxima discusión de un proyecto de resolución realizado por el ministro Luis María Aguilar Morales en el que declara inconstitucional la penalización del aborto en el estado de Coahuila y que, de ser aprobado por el Pleno será obligatorio para todos los jueces federales del país, el jurista señaló que existe el riesgo de que con este tipo de propuestas los ministros caigan en un activismo judicial basado en opiniones y corrientes de pensamiento.
En el proyecto de Aguilar Mora expone que el Estado mexicano está obligado a proveer de infraestructura accesible, asequible, aceptable y de calidad para la interrupción legal del embarazo.
