La réplica de Miriam Cárdenas ha sido de ‘extrañeza’ e incluso de un velado reclamo en contra de la ASE por haber afirmado que el dinero perdido sigue perdido en su totalidad
El Tribunal Superior de Justicia de Coahuila salió ayer, en voz de su presidenta Miriam Cárdenas Cantú, a “aclarar” las cosas en relación con la denuncia penal que, como se informó, interpuso la Auditoría Superior del Estado (ASE) en contra de cuatro exfuncionarios de dicha institución.
Como se publicó en nuestra edición de ayer, la Auditoría Superior determinó que al haber invertido en la extinta Ficrea, los funcionarios del Poder Judicial de Coahuila que autorizaron las operaciones violaron la ley y generaron un quebranto a la institución.
La conclusión a la cual ha arribado la Auditoría Superior es una a la cual pudo llegar cualquiera, pues como se ha dicho repetidamente, la información que demuestra tal hecho se ha difundido profusamente.
Pese a ello, la réplica de la titular del Poder Judicial del Estado ha sido de “extrañeza” e incluso de un velado reclamo en contra de la ASE por haber afirmado que el dinero perdido sigue perdido en su totalidad, pese a que en diversas ocasiones se ha difundido públicamente la recuperación de algunas cantidades que suman poco más de 26 millones de pesos.
“Me llama la atención que se diga que solamente se afirma que se ha recuperado sin que se demuestre, pero… ¿qué se tiene que demostrar?, no tenemos observación por parte de Auditoría, ni algún aviso.
“No me explico de dónde sale que sólo son afirmaciones. El auditor (Armando Plata) revisa año con año todos nuestros ingresos, claro que lo tiene (los documentos que comprueban los depósitos de reintegración de dinero), todo lo que movemos ellos son el ente encargado de ver cómo lo hacemos, de dónde proviene lo que se deposita”, ha dicho Cárdenas Cantú.
Por otro lado, la Magistrada Presidenta dijo que el Poder Judicial interpuso en su momento una denuncia penal en 2015, mucho antes de que la ASE presentara la propia.
Pero el posicionamiento –que se entiende es del Poder Judicial y no sólo de su titular– soslaya lo importante: lo que la Auditoría Superior reclama es el proceder de quienes autorizaron –ilegalmente– las inversiones en Ficrea, mientras que la denuncia del Poder Judicial se enderezó en contra de la financiera y no de los funcionarios hoy señalados.
Lo cierto hoy es que, aun con los recursos que han sido “recuperados”, la mayor parte de lo perdido sigue perdido. El problema de fondo, por lo demás, es que nunca debió perderse y si eso ocurrió es porque al frente del Poder Judicial estuvo alguien que actuó ilegalmente y permitió que otros hicieran lo mismo.
Vistas las cosas en perspectiva, resulta difícil de entender la posición de Miriam Cárdenas, pues no queda claro si sólo le molesta que las afirmaciones del Auditor Superior sean “imprecisas” o lo que pretende es afirmar que no hacía falta denunciar penalmente a quienes provocaron el quebranto al Poder Judicial, porque a los únicos que debe culparse de algo en esta historia es a los ejecutivos de Ficrea.
Valdrá la pena que la titular del Poder Judicial se tome la molestia de “aclarar” su aclaración.
