La Suprema Corte de Justicia de la Nación (SCJN) amparó a un colectivo, Sociedad Mexicana de Autoconsumo Responsable y Tolerante A.C. (SMART) para el consumo recreativo, lúdico, de la marihuana. Se trata de una decisión muy importante.
Es un paso adelante en la ruta contraria del modelo dominante, prohibicionista, sobre drogas. Con esta resolución México inicia el camino para ponerse al día de lo que ya ha pasado en otros países que se han adelantado en la ruta de legalizar lo que el brasileño Pedro Abramovay llamó “placeres legítimos” (EL UNIVERSAL, 4/XI/2015).
La despenalización de las drogas es un tema que divide y polariza, está lleno de prejuicios y afecta al grueso de la sociedad. Tiene implicaciones de salud, legales, de derechos y libertades. Hay concepciones diferentes sobre los niveles de intervención de los Estados en la vida de los individuos. Al mismo tiempo, existe un gran espacio para la especulación en donde interviene la información a medias que genera verdades a medias o proyecciones catastrofistas. Lo que resulta claro es que la clase política, casi toda, con excepción del PRD, que sí ha propuesto legislación en favor de la despenalización de las drogas, están en contra de la despenalización y a favor de mantener el modelo prohibicionista. La mayoría de los partidos y funcionarios en México prefieren mantener al país en la ruta más atrasada de la prohibición.
Fue interesante observar las múltiples declaraciones que se hicieron en las últimas semanas sobre el proyecto del ministro Zaldívar, en casi todos los casos salían a relucir prejuicios, temores, desinformación y en muy pocos casos se conocía la materia o el proyecto en cuestión. Incluso después de la decisión de la SCJN dominó una actitud contraria y timorata.
En el debate se puede resaltar que sí es importante la marihuana, que México es el segundo productor mundial, que hay muchas miles de personas en la cárcel por delitos relacionados con la Cannabis Sativa. Así, por ejemplo, entre 2009 y 2014 han sido detenidos unas 176 mil personas por posesión y unas 156 mil por consumo, y el 65% de las detenciones federales ha sido por delitos contra la salud (Marihuana, los limitados alcances de la decisión en la Suprema Corte, CIDAC, 4/XI/2015). Esta dimensión da cuenta de que estamos frente a un problema grave y que es urgente cambiar el enfoque de la penalización. Tampoco es menor la importancia del delito, ya que el 58.7% de los detenidos por alguna droga, es por marihuana, es decir, casi 6 de cada 10 personas (Primera Encuesta en Centros Penitenciarios Federales, CIDE, 2012).
Los países que han avanzado en materia de despenalización de las drogas, y de la marihuana, han adoptado diferentes modelos de regulación, se ha liberalizado el consumo y la venta de la marihuana. En Uruguay, el Estado cubre todo el ciclo desde la producción hasta la comercialización; en algunos países europeos, de forma emblemática en Holanda, el consumo está despenalizado desde hace décadas y hay establecimientos que comercializan de forma legal la venta de la Cannabis. En Estados Unidos los estados de Colorado y Washington permiten el consumo y la comercialización, y se trata de negocios regulados que pagan impuestos (www.chequeando.org, Marihuana: ¿sí o no?).
Aquí en México el camino todavía es muy largo. La decisión de la SCJN sólo ampara a SMART, por lo que se necesitará que haya otras cuatro resoluciones similares para que se pueda crear un criterio obligatorio que establezca jurisprudencia en la materia. Desde luego hay que modificar el paradigma prohibicionista para manejar el tema dentro de las políticas de salud pública y no dentro de las políticas de seguridad. La legalización de la Cannabis no va a resolver necesariamente el problema del narcotráfico y la violencia, pero quizá en algo pueda contribuir a mejorar la situación actual.
El ministro Cossío planteó una perspectiva importante para el futuro inmediato: “ajustar todo el esquema de la prohibición sancionada penalmente al de la legalización regulada bajo los parámetros generales de la salud pública y la protección de los derechos humanos de los consumidores y no consumidores”.
