Rechaza Sala Especializada del Trife recurso de ex candidata panista en Saltillo

La ex candidata albiazul por el 7° distrito interpuso un juicio en contra del priísta Jericó Abramo, a fin de que se anulara el triunfo de éste último por inequidad de cobertura informativa de las campañas por parte de los distintos medios de comunicación
Saltillo, Coahuila. El Tribunal Electoral del Poder Judicial de la Federación rechazó que el candidato del PRI a diputado federal en el distrito 07, Jericó Abramo Masso haya recibido mayor difusión de los medios de comunicación como lo argumentó la panista Dora Alicia Martínez Valero.
La ex candidata albiazul en el mismo distrito interpuso un juicio en contra del priísta, a fin de que se anulara el triunfo de éste último por inequidad de cobertura informativa de las campañas por parte de los distintos medios de comunicación.
Sin embargo, la Sala Regional Especializada del TEPJF desechó de plano el argumento de los abogados de la panista al considerar que carecía de elementos, además de que atentaba en contra de la libertad de expresión.
La Sala Regional estableció que la difusión informativa estuvo dentro de los márgenes constitucionales y legales establecidos para la libertad de expresión y el ejercicio periodístico.
Argumentaron que a la ciudadanía se les dio las opciones políticas para garantizarle su derecho a la información.
Los argumentos de los magistrados también fueron que debe respetarse el derecho a la información reconocido en la Declaración Universal de los Derechos Humanos, así como el Pacto Internacional sobre Derechos Civiles y Políticos.
El órgano jurisdiccional también señaló que tales derechos están reconocidos en la Convención Americana sobre Derechos Humanos y en la Carta Democrática de la Organización de los Estados Americanos.
En sus argumentos de decisión, los magistrados federales reconocieron el derecho a la información como una característica fundamental de la libertad de expresión, con el derecho a buscar, recibir y difundir información.
Los magistrados consideraron que limitar o restringir el derecho a la información afecta a los candidatos, partidos y sociedad en general.
Además, la misma Corte Interamericana de Derechos Humanos establece que la libertad de expresión, dentro del debate político y los procesos electorales, debe maximizarse.
La candidata de Acción Nacional presentó su recurso ante la Junta Local en Coahuila del Instituto Nacional Electoral el 8 de junio pasado, un día después de la elección federal.
La denuncia fue enderezada en contra del propio Abramo Masso y de diversos medios de comunicación impresos y electrónicos, acusándolos de contratación o adquisición y difusión de propaganda política no reportada al INE y posible inequidad en la cobertura noticiosa.
