‘Alito’ Moreno: ¿presunto delincuente o víctima?

El dirigente nacional del Partido Revolucionario Institucional (PRI), Alejandro Moreno Cárdenas, lleva ya varias semanas siendo protagonista de una polémica cuya piedra angular es la divulgación de un conjunto de grabaciones en audio, de presuntas conversaciones suyas, que apuntarían a la comisión de diversos delitos. Paralelamente, las autoridades de Campeche, estado que gobernó, han iniciado procesos judiciales en su contra.
Ayer se difundió un video
en el cual se observa a un grupo de policías ministeriales −encabezados por el fiscal General de Campeche, Renato Sales Heredia−, ingresando por la fuerza
en una vivienda, que presuntamente sería propiedad del dirigente político, para cumplimentar una orden de cateo expedida por un juez.
Alejandro Moreno calificó el hecho de “show mediático” y, como lo ha hecho desde que comenzó la difusión de los audios −que ha corrido a cargo de la propia gobernadora de Campeche, Layda Sansores− se dijo víctima de una “persecución política”.
La mala fama que acompaña a los políticos mexicanos −de cualquier signo ideológico− da para sospechar que Moreno Cárdenas podría ser responsable de las conductas que se le imputan y, por tanto, debería recibir el castigo que para las mismas prevén las leyes vigentes.
Sin embargo, en las sociedades democráticas el castigo a las conductas ilegales debe imponerlo un juez y ello solamente puede ocurrir después de que se desahogue un juicio apegado a lo que en la terminología jurídica se conoce como “debido proceso”.
De igual forma, y en apego a lo que establece la Constitución de nuestro País, toda persona debe ser considerada inocente mientras no se demuestre lo contrario. Y “demostrar lo contrario”, una vez más, implica el desahogo de un procedimiento preciso ante una autoridad jurisdiccional.
No se trata, y eso debe quedar muy claro, de defender al dirigente nacional del PRI o de intentar exonerarlo de antemano. De lo que se trata es de señalar que en este caso no se están siguiendo los procedimientos que establece nuestra Constitución y las leyes para proceder en contra de una persona a quien se presume responsable de conductas ilegales.
Lo que se percibe, por el
contrario, es que todos los esfuerzos del Gobierno de Campeche −y, presumiblemente, del Gobierno de la República− están orientados solamente a la obtención de dividendos políticos a través del desprestigio público de una persona.
Exigir que en éste, como en cualquier otro caso, se observen las reglas del debido proceso no implica asumir ligas de complicidad con nadie, sino defender el Estado de Derecho. Dejar de hacerlo implicaría extender carta de naturalización a los actos de abuso en el ejercicio del poder.
Alejandro Moreno, o cualquier otro individuo, puede ser responsable de las conductas
que se le imputan, pero la forma en que la autoridad actúa en su contra lo hace ver, por lo pronto, como víctima de un exceso
autoritario.
