Indaga FGE de Coahuila presunta firma falsa de pagaré en caso SMA
La Fiscalía General de Coahuila confirmó que el presunto suscriptor del pagaré que ha dado origen a la demolición del edificio de la Sociedad Manuel Acuña, compareció ante el Ministerio Público ante quien testificó que él no firmó ese documento.
VANGUARDIA publicó en su suplemento Semanario, que esta asociación se encuentra inmersa en un posible caso de fraude procesal y administración fraudulenta en modalidad de simulación de contratos, que derivó en una demolición, casi total, del edificio.
“Hay testimonios en el sentido de que no lo firmó él; (el testimonio efectivamente se rindió) ante la Fiscalía”, destacó el fiscal Gerardo Márquez.
Semanario publicó las versiones de fuentes que aseguraron que Juan Alfonso Aguillón González, entonces presidente de la Sociedad Manuel Acuña, presuntamente firmó un pagaré suscrito el 20 de septiembre de 2013 para reconocer un préstamo de 5.25 millones de pesos de manos de Óscar Sala Luna.
Márquez Guevara señaló que, sin prejuzgar, con un avance del 85 por ciento en las investigaciones, se puede afirmar que sí se cometieron delitos en este caso.
“La línea de investigación nos sigue apuntando a la confirmación de la comisión de una conducta ilícita, no podemos asegurarlo en este momento, pero con ese 85 por ciento que traemos de avance en la investigación, asumimos que hay elementos suficientes, hasta este momento. Para pensar, para suponer, para que con los indicios nos indiquen, que así es”, precisó el Fiscal.
En este contexto, Gerardo Pérez Pérez, abogado especialista en derecho penal, consideró que de acuerdo a los datos dados a conocer por el fiscal, la dependencia tiene los elementos suficientes para lograr un paso más, que es la audiencia para imputar a los señalados.
Dichos elementos son el juicio mercantil, los datos que la denuncia arroja, la información obtenida en el Registro Público y la declaratoria de Aguillón al desconocer la firma en el pagaré, señaló Pérez.
El abogado dijo que los delitos que se manejan, como administración fraudulenta en modalidad de simulación de contratos no ameritan prisión preventiva oficiosa.
